How to Transfer Vehicle Ownership

Obligation on Transfer

A person selling the vehicle must within 15 days of sale inform and request the Authority to transfer the ownership in the name of the person buying the vehicle.

 Penalty: 2 units (Nu.100) per day after 15 days.

Transfer of Ownership

Requirements:

(1)     An application for transfer of ownership of a vehicle must be accompanied by:

  1.  A deed of sale which includes the sale price of the vehicle and the signature of the seller and buyer, signed across a legal stamp by both the parties and a witness from each party;
  2. The registration certificate for the vehicle;
  3. A clearance certificate from Central Registry (CIB), Royal Monetary Authority (RMA) of Bhutan or the financial institution stating that the loan on the vehicle has either been fully paid out or that the financier has no objection to the transfer of the loan along with the transfer of the vehicle ownership or have no loan against the given vehicle.
  4.   clearance from the Court, if the vehicle is subject to any legal dispute;
  5. The fee and charges for change of ownership, including the property transfer tax indicated in schedule-
  6.  Seller should inform the authority in writing immediately upon sale of vehicle
  7. Photocopy of Citizen Identity Card of the buyer.
  8. Copy of the marriage certificate if the transfer is from Husband to Wife or vice-versa and from parents to offspring upon producing appropriate evidence (Family Tree information from Census).
  9. Vehicle Ownership Transfer within 5th year from the date of registration, particularly for third country import vehicles, registered in the name of diplomats/expatriates must produce tax clearance certificate from Ministry of Finance (Department of Revenue and Customs).
  10. All vehicles that were exempt from Tax/Duties during initial purchase must produce tax clearance certificate at the time of transfer of ownership
  11. One recent passport size photograph of the buyer/new owner.

 Payment of Transfer Tax

(1) Responsibility for payment of property transfer tax shall lie with the seller, except in case:

  1. Of a vehicle purchased from the Government on allotment
  2.   Vehicle sold by international and diplomatic agencies; or
  3. Of the seller exempt from the transfer tax, in which case, the buyer shall pay the transfer tax unless he can produce a certificate of exemption from the Ministry of Finance.

 (2)  If, in the opinion of the Authority, the sale value has been under stated in the sale deed, it is empowered to carry out revaluation of the vehicle using the formula under sub-section (3).

(3)  For the purpose of charging 1% (or as may be amended from time to time) vehicle ownership transfer tax, the Authority shall apply depreciation at the following rates on the initial purchase price (on production of original invoice/bill or similar records maintained by the Authority) or the current market value of a similar type, using the diminishing balance method:

  1. @ 10% per annum for first and second year;
  2. @ 15% per annum for third, fourth, fifth and   sixth year; and

(4)   a motor vehicle shall be valued at 10% of the initial purchase price (as indicated in the original invoice/bill or similar records maintained by the Authority) or the current purchase price (of a new vehicle) of the same or similar description, after the sixth year.

(5)  Where a vehicle is seized and auctioned by the financial institution to recover its loan, the previous owner in whose name the loan is outstanding, will be subject to transfer tax on the actual amount received by the property owner after adjustment of the outstanding loan amount.

(6)  n case of a vehicle sold as scrap, the owner is liable for transfer tax on the sale value of the scrap and must surrender the registration certificate to the Authority.

NOTE:   Vehicles gifted as SOELRA/gift, bought from RGOB projects etc. are also liable for 1% transfer tax.

 Exemption from payment of property transfer tax

Payment of property transfer tax is exempt in case of the ownership being transferred:

  1.  From parents to children
  2.  From husband to wife or vice-versa
  3. From one privileged person to another, being the transfer of allotment;
  4. Between exempt international organization;

How long will it take to transfer the ownership?

Provided all documents and other requirements fulfilled, ownership can be transferred within one working day.

What are the fees and charges applicable to ownership transfer?

  • Ownership Change fee:                                         Nu.500/-.
  • Registration Certificate Cost:                                 Nu.500/-.
  • Property Transfer Tax:                                          1% on the accessed value.

Replacement of Vehicle Registration Certificate

What should I do when renewing a registration certificate?

  • he owner of the vehicle must arrange to renew the registration certificate from the expiry date of the current registration after furnishing the registration certificate to the authority (any Regional or Base Office) for amendment.A late penalty of Nu.10/- per day for all types of vehicle will be imposed.
  • The original registration certificate must be produced while renewing.

Note:

In case of any vehicle undergoing major repair,the owner must inform the authority in writing at the time of taking the vehicle for repair,and must surrender the registration certificate to the authority.After the repair ,the owner must furnish an authentic evidence or a certificate from the concerned workshop after the repairs have been completed,showing the duration of repair.Approach the nearest RSTA office to renew your documents.

Road Worthiness Test

  • The Vehicle fitness test must be done at the date of expiry (which is the same with the Vehicle renewal date). Failing to renew on or before expiry date shall be imposed a penalty of Nu.50 per day. Vehicle fitness is considered to be one of most important work of the Transport Authority to insure that the car is safe to drive and is in good condition to run with out any problem for both self and other road users.
  • RC Renewal and Motor Vehicle Fitness fees.

Replacement/Duplication of RC

  1. Submit an application to the nearest Traffic police immediately for clearance and issuance of duplicate license.
  2. The concerned owner of the vehicle must then inform the nearest RSTA for duplication of RC in writing with the valid Registration number.
  3. Replacement/Duplication can be done in a day after verification and payment of nu.500/-.

How to Register a Motor Vehicle

What are the requirements for registering a motor vehicle?

  • Duly filled in registration application form
  • Original Invoice
  • ID Card copy (the applicant should be 18 years and above)
  • One passport size photograph (recent)
  • Original customs clearance (if purchased from authorized dealer outside Bhutan )
  • Import license /quota (in case of purchase from third country )
  • Tax clearance receipt in original
  • Green Tax receipt in original
  • Emission certificate ?Euro 03/Euro 04 compliant
  • Vehicle should be brought for physical inspection

Please note:

Only new vehicles can be registered. Second Hand/used vehicles registered in other country cannot be registered in Bhutan.
All new vehicles must be brought for physical inspection by the Motor Vehicle Inspector of RSTA during the time of registration. After registration, the applicant is required to produce the vehicle for fitness inspection with the number plate displayed both at the front and the rear, exactly as per the standards prescribed by RSTA regulations. Please note that slanting/shiny letters/numbers and embossed numbers are not allowed.

Caution

An application for vehicle registration must be completed within 15 days from delivery of vehicle from the Custom Authority or the authorized dealer. The penalty for exceeding 15 days is Nu. 100 per day.
